if hirschmann is unable to carry out the services as described in the contract or its performance is prevented by a third party, the customer may cancel the contract without undue delay or early termination. the services may be terminated by the customer without a fee payment, and hirschmann is entitled to charge a fee that it deems necessary for the duration of any such period. in the event of early termination of the contract, the customer shall immediately return to hirschmann or destroy the software (as well as the corresponding media) and any other copies and modified versions of the software and the accompanying documentation.
the customer may not modify the software other than for the purpose of connecting to a hirschmann network infrastructure device to access the service, provided that the modified software is not a modified version of the software available for download from the hirschmann website. the customer may not transfer the software to third parties. any customer-specific data, which are not a result of modification of the software, are in any case not transferred to third parties. all rights in the customer-specific data are reserved to hirschmann. the customer shall not use the modified software or the software key except with the explicit permission of hirschmann.
the customer shall assume the entire risk and liability relating to the use of the software, the documentation and the associated media in the context of the customer’s employment. this also applies to the embedded software. hirschmann assumes no liability whatsoever for any damage caused to third parties by the software or by the customer.
the software is intended for personal use only. any other use or unauthorized use by you or your licensees of the software, including without limitation for any commercial or business purposes, is strictly prohibited. the software is not to be used in any way that is inconsistent with any applicable laws or regulations.
the software is subject to separate maintenance and support agreements for the specific product versions supported by the software. these agreements can be obtained from the customer service during installation or download of the software. the license to use the software does not include the right to use the support services.
the software is subject to separate license fees for use by the customer on multiple platforms, e.g. in the case of pcs. separate license fees for use on different platforms are to be negotiated separately. in cases in which separate license fees are not agreed upon, the fees for the software provided are included as a once-off license fee in the purchase price of the products, systems or devices equipped with the software.
fees for the right of use of the delivered software shall be agreed upon as a one-time license fee, plus the corresponding value-added tax as required by law. in the absence of a specific agreement to the contrary, the license fees for the software provided are included as a once-off license fee in the purchase price of the products, systems or devices equipped with the software.
insofar as the software is labelled or designated as an update, in order to use this, it is necessary to obtain a license for a product which is defined by hirschmann as suitable for the update (hereinafter referred to as a suitable product). a software product which is labelled as an update replaces and/or augments the starting product. the customer may use the resulting updated product only in compliance with the provisions of these software conditions. insofar as the software is an update of a component of a software program package which the customer has licensed as a unified product, the software may be used only as part of that unified product package and may not be separated for use on more than one computer. if the software is a client-server application the client can be used on different hardware.
